3 What data do we process?

We process the following categories of Personal Data:

  • General Personal Data (e.g., name, address, contact details, job title, communication data).
  • Contract data that is collected in relation to the conclusion or performance of a contract.
  • Special categories of Personal Data only if specifically and explicitly provided by you or required for a service we provide (e.g., health data, biometric data), and only to the extent permitted under applicable law.
  • Data about your use of our website and services (e.g., IP address, device information, usage data) when you access our website or use our services.

We collect the Personal Data (i) directly from you (e.g., during contract negotiations, service delivery, via forms or email), (ii) from third parties (e.g., references, partner organisations) only when you have given your consent or when permitted by law. We do not purchase Personal Data of individuals from marketing lists without their prior consent.

4 For what purposes do we process your data?

We process your Personal Data for the following purposes:

  • To provide, manage and maintain our services and contractually agreed deliverables.
  • To communicate with you, respond to inquiries, and support you as a client, service provider or partner.
  • For billing, accounting and tax purposes.
  • For marketing and promotional purposes (only if you have consented or where legitimate interest applies) — e.g., sending newsletters or event invitations.
  • To ensure compliance with legal obligations (e.g., anti‑money‑laundering, data retention) and to establish, exercise or defend legal claims.
  • To improve our website, business operations, services and user‑experience, including through analytics and feedback.

5 On what basis do we process your data?

We process your Personal Data in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR). Depending on the specific processing activity, we rely on one or more of the following legal bases:

  • Performance of a contract or pre-contractual measures – e.g., when processing data necessary to enter into or perform a contract with you.
  • Compliance with a legal obligation – e.g., when we must process data to fulfil statutory or regulatory duties.
  • Legitimate interests – e.g., to ensure IT and network security, manage our business operations, or market our services, provided your interests and fundamental rights do not override ours.
  • Consent – where you have provided your explicit consent, e.g., for marketing communications or processing of special categories of data.
  • Vital interests of the data subject or another person, if applicable.

Where we rely on consent, you may withdraw it at any time with future effect. The withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.

6 Profiling and automated individual decision‑making

We do not carry out automated decision‑making, including profiling, which produces legal effects concerning you or significantly affects you.

7 With whom do we share your data?

We may disclose your Personal Data to the following recipients:

  • Service providers: We work with service providers in Switzerland and abroad who process your data on our behalf or as joint controllers with us or who receive data about you from us as separate controllers (e.g., IT providers, shipping companies, security companies, banks etc.)
  •  Contractual partners: This refers to contractual partners as this data disclosure results from the contracts.
  • Authorities: We may disclose personal data to agencies, courts and other authorities in Switzerland and abroad if we are legally obliged or entitled to make such disclosures or if it appears necessary to protect our interests.

We do not sell your data.

8 Is your Personal Data transferred abroad?

As explained in section 7, we disclose data to other parties. These are not all located in Switzerland but also in Europe.

If, in exceptional cases, your data is transferred to a country without adequate statutory protection, adequate safeguards (e.g. SCCs) are implemented, ensuring equivalent protection.

9 How long do we process your data?

We process your data for as long as our processing purposes, the legal retention periods and our legitimate interests in documentation and keeping evidence require it, then delete or anonymize it.

10 How do we protect your data?

We implement technical and organisational measures to protect your data, including encryption and access control.

11 What are your rights?

You have rights under FADP and GDPR (access, rectification, deletion, restriction, objection, portability, withdrawal of consent). If you wish to exercise those rights, please contact us at info(at)chainolution.ch.
